Terms and Conditions of coaching with me:
Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximise personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.
1) Ownership
The Client is solely responsible for creating and implementing their own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and their coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
2) The Coaching Relationship
The client understands that “coaching” is a Professional-Client relationship they have with the coach that is designed to facilitate the creation/development of personal, professional or business goals, and to develop and carry out a strategy/plan for achieving those goals. The Client understands that coaching is a comprehensive process that may involve all areas of life, including work, finances, health, relationships, education, and recreation. The client acknowledges that deciding how to handle these issues, incorporate coaching into those areas, and implement my choices is exclusively their own responsibility.
3) Coaching Context
The Client understands that coaching does not involve the diagnosis or treatment of mental disorders as defined by RANZCP. The Client understands that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and they will not use it in place of any form of diagnosis, treatment or therapy.
4) Duty of Care
If the Client is currently in therapy or otherwise under the care of a mental health professional for the areas that are intended to be worked on in the coaching session, they agree to have consulted with the mental health care provider regarding the advisability of working with a Coach and that this person is aware of the client’s decision to proceed with the coaching relationship. The Client agrees to disclose details of the past or present psychological or psychiatric treatment. In entering into the coaching relationship and signing the agreement, the Client is agreeing that if any mental health difficulties arise during the course of the coaching relationship, they will notify the Coach immediately so that they can discuss with appropriate steps and if any additional referrals are needed. If necessary, a referral from the mental health professional may be requested prior to working with the Coach.
5) Confidentiality
The Client understands that information will be held as confidential except as required by law. Certain topics may be anonymously and hypothetically shared with other coaching
professionals for training OR consultation purposes. The Client understands that in order to enhance the coaching relationship, they will communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program. All information about the Coach / Client relationship will remain strictly confidential except in very rare circumstances where decreed by law; ie. where the court might issue a subpoena for the file or information or there may be perceived harm to the client or others. If the Client wishes for the Coach to speak to someone outside interactions, then the Client will need to give written permission (original letter, fax or email) to do so. Exceptions to confidentiality of course relate to circumstances such as intent to seriously harm someone, child abuse etc. Otherwise, all information is confidential.
6) Independent Advice
The Client understands that coaching is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual or other qualified professionals. The Client will seek independent professional guidance for legal, medical, financial, business, spiritual or other matters.
7) Responsibility
The Client understands that all decisions in these areas are exclusively their own and acknowledge that their decisions and actions regarding them are their sole responsibility.
Except as expressly provided in this Agreement, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the
coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services.
8) Rescheduling or Cancellations
If the Client needs to reschedule a session, please provide at least 24 hours’ notice. If 24 hours’ notice is not given for rescheduling or cancellation of a session, fees apply such as 50% of the total sum for less than 24 hours’ notice given or 90% of the total sum if 1 hours’ notice given.
9) Description of services
The services to be provided by the coach to the client are zoom coaching, as agreed jointly with the client.
10) Responsibility for change
The Client understands that successful coaching requires a co-active collaborative approach between Client and Coach. In the coaching relationship, the coach plays the role of a facilitator of change, but it is the client's responsibility to enact or bring about the change. If the Client believes the coaching is not working as desired, the client will communicate and take action to return the power to the coaching relationship. The Coach reserves the right to terminate the coaching relationship if the Client is not collaborating and open to change.
11) Boundaries
The Client can, at any point in the coaching session, declare their preference not to discuss a specific issue, by simply stating that they would rather not discuss this issue. The Coach agrees to respect this boundary and will not attempt to forward the conversation further along those lines.
12) Refunds
Strictly no refunds are offered after the coaching session or within 24 hours of the scheduled session. Refunds are possible if you wish to cancel the session more than 24 hours before the scheduled time of the session.
